you can buy an iPhone without signing a contract (eBay, from a friend, etc.) however you cannot get service for the iPhone (in the U.S. at least) without entering into an agreement with a carrier, which a court will enforce as a contract, regardless whether there's a physical signature or not.

Unfortunately, seeing as the iTunes link is Apple's money making link, I cannot see them allowing this to happen for a long time, meaning it will never grow to it's full potential as a fully independent device.
If I were to speculate, I would guess that linking to the iTunes PC/Mac software is merely a transitional state (a launch pad to tap into the their existing iPod customer base)
I believe that they will eventually try sever the link from the PC/Mac iTunes client software and have all devices link over the internet back to Apple iTunes service. That is Home Base will not be your PC but rather Apple's servers, this will create more reliance/stickiness to Apple.
Where your media is stored is still up in the air (cloud?)... Cloud makes sense from a profit perspective because it creates the most stickiness, but obviously it may not appeal to many consumers.
What's certain is the trend to move to an OS where the user does not directly interact with the underlying OS. They need to access their files, media, but that can be through an application versus meddling with the underlying OS file system directly... meaning that things are trending (for the avg user) towards more of an iOS and less of an OSX.

The problem is demonizing people who are living living their lives in ways that cause no harm to the person condemning them, nor to any other identifiable person.

Sounds amazing like the same business model that has been followed by the Mac. A device with OS competing against an OS that will run on many devices. Current Mac market share 5.12% current Windows 92.77% (based on numbers from Market Share) . Does anyone else see this connection?

Google tries to be a better Microsoft by providing an _open_ software platform for multiple hardware makers, but they will not replicate MS's success, since MS dominated the OS market from the beginning and knew how to milk it whereas Google was late to a crowded party. Google may offer cheap drinks, but not fancier ones.
computers: MS and Intel take the cream and will do for a long time thanks to their near-unbreakable monopolies, most others are struggling.
mobiles: Nokia TOOK the cream in the past, in the future it will be Nokia, RIMM and Apple. It don't see any chance for Google to make equally big profits here. Android is merely treated as a means to secure their Web monopoly.

Isn't this misleading? It says 'shipped' not 'sold' so I assume basically it's a bogus report. You can ship all the crappy tablets you want..doesn't mean they sold.
arguably yes,,,, but it's hard to get 'sold' data. that is 10 manufacturers may ship to lots of distributors who sell to thousands retails or re-distributors (enterprise) who may sell them again. To get 'sold' data is difficult, so they get 'shipped' data instead and just throw in a margin of error.
It's better to focus on the *trend* then dismiss a report because number may be slightly off (stats are never entirely accurate and can be messed with)

I agree with your pro-nuclear, pro energy independence stance, Fivepoint.
Third, we do in fact have the resources to provide for our own society. Expand nuclear, expand oil, expand coal, expand natural gas, expand biofuels, keep investing in promising new alternatives (private investment, not government) and we could get to energy independence in probably 10 years or less. The only reason we're not doing it is because of burdensome government regulations and the fact that other countries can produce it cheaply. As prices rise, one of those issues becomes moot... Also, for the record, just because we could do it, doesn't necessarily mean we should. The free market should determine this. IF we're willing to pay more for American fuel, then so be it. If not, we'll continue buying from others... but don't let the government manipulate the markets and destroy common sense capitalism.

Even as a small-government advocate, I'm assuming that you see defence as something that should remain the role of the state? How then to create a level marketplace where foreign oil benefits from such a massive indirect government subsidy?
Perhaps it would be appropriate to have domestic nuclear reactors built, as a security measure and as part of the defence budget?

Big Thumbs up AT&T. I am glad they are just taking it to enroll people into the 2gig plan and add tethering, saves people the trouble of having to do it themselves!
Plus I won't have to subsidize their data usage from their stealing bandwidth and access from AT&T.
I can't wait though, in a few weeks / months, though, when we start seeing people complaining how AT&T screwed them and changed their dataplan even though they did nothing wrong and weren't using MyFi and AT&T is horrible and a crook.

Is it just me or does the iTV look very stackable? My guess is that eventually you will have a Hard Drive, Optical Drive and the iTV all separate. This way you can upgrade to a BlueRay from a DVD drive or a 500Gig HD from a 250.

I actually like no built-in hdd. Storage should be attached physically or over the network. What's necessary on the client, and this iTV is definitely a client, is intelligent volume management. It should allow me to combine any number of physical disks into a single logical volume.
The same footprint as Mac Mini is also probably not a coincidence. If you want, you can stack both of them.

Update: There's no evidence of any radioactive leakage, but officials have confirmed that the cooling process for the nuclear plant has not yet gone according to plan.
Update 2: Japan has declared a nuclear emergency.
Update 3: 2000 residents near the Fukushima Nuclear Plant have been urged to evacuate.
Update 4: According to reports, Japanese jets have been ordered to fly over the Fukushima Nuclear plant
Update 5: According to Reuters, a Dam has broken in the same region as the at-risk nuclear power plant.

This is not only the kind of dumb prediction that so exercises Nassim Talib, it is utterly meaningless and almost certainly wrong.
If you look at the two platforms, it's clear one [Apple's iPhone] is on a clear path that's now 28 months old. The other [Google et al's Android] is barely out of diapers, with one model down and the latest not exactly pulling up any tree roots yet.
The old 'build it and they will come' maxim only works if what you're selling is what people want. And that's the great unknown. Actually it's an unknowable unknown. But we do have some clues.
Apple has a loyal following and a great reputation for selling reliable software and hardware in one package. And that, as anyone who's bought a Nokia from Orange UK recently will know, is a much better solution. Oh, and women won't buy anything called 'Android'.
I have no idea what shape the Android market will be in in two years time, but I predict two things: With 40 different models, each with a vast array of different functionality, from any number of manufacturers, they have a compatibility nightmare on their hands, and absolutely no chance of creating any kind of buzz. Indeed, Microsoft have a better chance with whatever vision of ugliness they eventually spew out!
So, my fellow Macrumors posters, how about a wager?
I predict the true situation by 2012 will not be as Gartner suggest. I believe Apple will have their iPhone available all over the World with multiple carriers in each region, and that Apple's iPhone App, not Android will be in the number one spot. Indeed, I question whether the experiment will grow much beyond a techie wet dream.
I also predict that the Kindle will end up remaindered by the end of 2012. The only thing that might upset this is if they pull a colour screen and better battery out of the bag, and beat Apple's iPad on features and price. I don't see Amazon making that level of R&D investment, or being capable of leveraging that kind of buying power - ever.

I disagree with the line of thought that Macbooks will remain with yonah processors. heres why:
intel has announced merom will ship at the same price point as yonah. they are pin compatible. Apple can, therefore, simply fit the chips without increasing the macbooks price point/ incurring in high engeneering costs.
One might say: oh, but theyll do it to differentiate the mb from the mbp.
Seems to me that if they were concerned with pushing a high performance gap they wouldnt have specced the mb so similarly to the mbp in the first place.
seccondly, it makes no business sense. Apple knows people are holding out for merom. this will increase after its been released. if they choose to keep yonah just to justify the price gap between the mb and the mbp, theyll be alienating buyers y crippling its product without sound reason. Mac users are tech savvy. theyd be put off by being forced to by a yonah notebook with merom widely available. It will happen and its Intels merit.
lastly, lets not forget the "dell factor". If apples consumer laptops are ony available with yonah, and dells consumer laptops are fitted with merom at the same price point, I think we would see a lot of would be switchers not switching.
Conclusion: all apple would benefit from keeping yonahs in the macbooks would be to make mbp users feel happier about their machines. on the other hand, it would lose sales of macbook from customers (i) not switching or (ii) further delaying their purchase. Doesnt make business sense to me
intel has announced merom will ship at the same price point as yonah. they are pin compatible. Apple can, therefore, simply fit the chips without increasing the macbooks price point/ incurring in high engeneering costs.
One might say: oh, but theyll do it to differentiate the mb from the mbp.
Seems to me that if they were concerned with pushing a high performance gap they wouldnt have specced the mb so similarly to the mbp in the first place.
seccondly, it makes no business sense. Apple knows people are holding out for merom. this will increase after its been released. if they choose to keep yonah just to justify the price gap between the mb and the mbp, theyll be alienating buyers y crippling its product without sound reason. Mac users are tech savvy. theyd be put off by being forced to by a yonah notebook with merom widely available. It will happen and its Intels merit.
lastly, lets not forget the "dell factor". If apples consumer laptops are ony available with yonah, and dells consumer laptops are fitted with merom at the same price point, I think we would see a lot of would be switchers not switching.
Conclusion: all apple would benefit from keeping yonahs in the macbooks would be to make mbp users feel happier about their machines. on the other hand, it would lose sales of macbook from customers (i) not switching or (ii) further delaying their purchase. Doesnt make business sense to me

I think you missed the point of that one. h'biki was saying that if someone, let's say someone well-known, like Britney Spears, got a copy of your wedding video and used it to make a music video for her latest song, that it wouldn't hurt anyone. It'd just be infringing on copyright, after all, even though it's your face and your wedding that's now on MTV without your permission.
And to your earlier comment, yes, breaking the law is wrong. If the law is unfair and unjust, you change the law. The exception to this is when the law, again, as I said and you must have skipped, causes you direct personal or meaningful financial harm. Then you might have an argument for breaking the law. Otherwise, the right thing to do is to have the law changed. The digital music situation fits into this category. If you break the law, you don't encourage the law being changed, and there is no immediacy of threat to justify your illegal actions except that it's more convenient for you and that you don't care about the law. You're the reason DRM exists in the first place.
